A BILL FOR AN ACT

 

 

relating to renewable energy.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that a strong agricultural sector is essential for Hawaii's food security and can be an integral part of Hawaii's energy security.  Long term contracts for biomass production can improve agricultural producers' economic position while contributing to Hawaii's energy diversification. 

     The purpose of this Act is to require that by 2015, a minimum of two per cent of each utility's renewable portfolio standard be from biofuel or from agricultural producers.

     SECTION 2.  Section 269-92, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The public utilities commission may establish standards for each utility that prescribe what portion of the renewable portfolio standards shall be met by specific types of renewable energy resources; provided that:

     (1)  Prior to January 1, 2015, at least fifty per cent of the renewable portfolio standards shall be met by electrical energy generated using renewable energy as the source, and after December 31, 2014, the entire renewable portfolio standard shall be met by electrical generation from renewable energy sources; provided that after December 31, 2014, at least two per cent of the renewable portfolio standard shall be met by electrical energy generated using agricultural energy as the source.  For the purposes of this paragraph, "agricultural energy" includes energy produced:

         (A)  By a biofuel processing facility, as defined in section 205-4.5(a)(15), which is located in the State and produces more than five hundred thousand gallons of biofuel per year;

         (B)  Using commercial agricultural products or commodities raised, grown, or maintained in the State by a commercial agricultural enterprise that produces more than one million pounds of products or commodities per year; and

         (C)  By a commercial agricultural enterprise that produces more than one million pounds of products or commodities per year;

     (2)  Beginning January 1, 2015, electrical energy savings shall not count toward renewable energy portfolio standards;

     (3)  Where electrical energy is generated or displaced by a combination of renewable and nonrenewable means, the proportion attributable to the renewable means shall be credited as renewable energy; and

     (4)  Where fossil and renewable fuels are co-fired in the same generating unit, the unit shall be considered to generate renewable electrical energy (electricity) in direct proportion to the percentage of the total heat input value represented by the heat input value of the renewable fuels."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2010.
