A BILL FOR AN ACT

 

 

RELATING TO DRIVERS LICENSES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 286-109.5, Hawaii Revised Statutes, is amended to read as follows:

     "§286-109.5  Designation of anatomical gift.  (a)  The examiner of drivers shall design and implement a system to request anatomical gift information from all applicants for a driver's license or license renewal, at the time of application[, including a].  The system shall include:

     (1)  A method of directly imprinting on a license an applicant's designation of whether the applicant wishes to be an organ donor[.  The request shall elicit];

     (2)  An elicitation whether the applicant wishes to be an organ donor in the event of the applicant's death[.]; and

(3)  Information regarding anatomical gifts and anatomical gift procedures.

     (b)  The department of health shall provide assistance as requested by the examiner of drivers in the development, preparation, and publication of information relating to anatomical gifts and anatomical gift procedures for drivers license or license renewal applicants.

     (c)  The director of transportation shall include in any State publication designed to help applicants qualify for a Hawaii driver’s license and approved by the department of transportation, information regarding anatomical gifts and anatomical gift procedures.  The department of health shall provide assistance as requested by the director of transportation in the development, preparation, and publication of information relating to anatomical gifts and anatomical gift procedures for drivers license or license renewal applicants."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
