A BILL FOR AN ACT

 

 

RELATING TO SCHOOLS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§711-    Bullying in school.  (1)  A person commits the offense of bullying in school if the person intentionally subjects a primary or secondary school student to bullying with intent to create, or in reckless disregard of the risk of creating, an intimidating, threatening, or abusive educational environment for the student being bullied.

     (2)  Bullying in school is a misdemeanor.

     (3)  A person convicted under this section shall be required to undergo a counseling program as ordered by the court."

     SECTION 2.  Section 711-1100, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Bullying" means any written, verbal, or physical behavior committed by a person, whether a student or not, against an elementary or secondary school student, whether in person, by electronic transmission, or otherwise, that causes physical or psychological harm to the student."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
