A BILL FOR AN ACT

 

 

relating to water.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 174C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§174C-     Nonpotable recycled wastewater; reuse; restrictions.  (a)  Notwithstanding any other law to the contrary, no later than January 1, 2025, only nonpotable recycled wastewater shall be used for the following purposes:

     (1)  Agricultural cultivation;

     (2)  Irrigation of state and county park grounds;

     (3)  Irrigation of public and private school and university landscaping and grounds;

     (4)  Irrigation of public and private golf courses and grounds; and

     (5)  Operation of public and private decorative water features.

     (b)  This section shall not apply to the use of:

     (1)  Untreated rainwater for irrigation purposes, whether occurring naturally or collected and used for irrigation purposes; or

     (2)  Gray water from residential units for irrigation purposes pursuant to section 342D-70.

     (c)  As used in this section:

     "Decorative water feature" means any artificial fountain, lake, pond, stream, or waterfall that is not intended to provide drinking water for humans or to be used by humans for swimming or other recreational activities.

     "Gray water" has the same meaning as defined in section 342D-1.

     "Nonpotable recycled wastewater" means wastewater that has been treated and made suitable for one or more specified beneficial uses, in compliance with chapter 11-62, Hawaii administrative rules, but is unfit for human consumption."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
