A BILL FOR AN ACT

 

 

relating to historic preservation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§6E-    Plan approval or acceptance.  (a)  The approval or acceptance of any archaeological inventory survey, mitigation plan, preservation plan, interpretive plan, or other plan or study by the state historic preservation officer shall be of no further force or effect with the passage of ten years from the date of the original approval or acceptance.

     (b)  If any action requiring the approval or acceptance of the original inventory survey, mitigation plan, preservation plan, interpretive plan, or other plan or study is required ten years following the approval or acceptance of the original plan or study, the state historic preservation officer shall require that a new plan or study be prepared or that the original plan or study be updated for the approval and acceptance of the state historic preservation officer.

     (c)  The board of land and natural resources may adopt rules under chapter 91 necessary to implement this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
