A BILL FOR AN ACT

 

 

RELATING TO HUNTING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that mentored hunting, also called apprentice hunting, allows a person to try hunting prior to completing any required hunter education courses and allows young hunters and their families to enjoy sporting traditions together.  Presently, more than half of the states in the nation operate a mentored hunting program.  These programs attract new hunters of all ages by allowing the prospective hunter to gain experience under the direct supervision of a seasoned mentor.  These programs also allow for young hunters' earliest hunting experiences to involve active participation, rather than classroom hunter education courses.

     The purpose of this Act is to require the department of land and natural resources to issue Hawaii hunting apprentice permits authorizing persons without a hunting license, including children, to hunt under direct supervision of a licensed hunter, with certain restrictions for apprentice permittees who are ten years old or younger.

     SECTION 2.  Chapter 183D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§183D-     Hawaii hunting apprentice permit.  (a)  The department shall issue a Hawaii hunting apprentice permit to any Hawaii resident over the age of seven who:

     (1)  Has never been issued a hunting license in the State; and

     (2)  Submits a written application in the form prescribed by the department; provided that an application on behalf of a minor shall be submitted and signed by the minor's parent or legal guardian.

     A permit issued pursuant to this section shall be valid for twelve months and shall be renewable for one additional twelve-month period.

     (b)  Any Hawaii hunting apprentice permittee may accompany a licensed hunter and may engage in hunting; provided that the permittee shall:

     (1)  Possess the Hawaii hunting apprentice permit;

     (2)  Be accompanied by a licensed hunter who is twenty-one years of age or older; and

     (3)  If ten years of age or younger, be prohibited from using or possessing a loaded weapon of any kind, fireable cartridges, muzzleloading firing components, or broadhead arrows."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2014.
