A BILL FOR AN ACT
Relating to state purchases.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that it is in the public interest to utilize taxpayer funds, which provide for state purchases, to support American industry.
The legislature further finds that the accepted rule of what constitutes a "made in America" product is defined by the Federal Trade Commission, stating that "all or virtually all" significant parts, processing, and labor that go into a product must be of American origin.
The purpose of this Act is to require the State of Hawaii to prioritize products "made in America" for all state purchases in cases where Hawaii products are unavailable, as authorized by §103D-1002.
SECTION 2.
Chapter 103D Part X, Hawaii Revised Statutes, is amended by adding a new section
to read as follows: [§103D-1013 "made in America" preference.
(a) Where
a bid or proposal contains goods of Hawaii and non-Hawaii origin, preference shall
be given to products of Hawaii origin, as defined in §103D-1002.
(b) Where
a bid or proposal contains goods of American origin (excluding Hawaii origin) and
non-American origin, preference shall be given to products of American origin.
(c) When
purchasing goods of American origin, the following prioritization shall be observed:
"made in America" with guidelines outlined by the Federal Trade Commission,
"made in America from domestic and foreign parts", and "assembled
in America".
(d) Under conditions where a "made in America"
product is unavailable or of unacceptable cost, subsequent prioritization shall
observe the following order: "made in America from domestic and foreign parts",
"assembled in America", and lastly, products of foreign origin.
(e) This
practice shall be implemented over a ten year period. The starting rate shall be
10% of state purchases in year one, and increasing by an additional 10% each subsequent
year, for the duration of the ten year period.
