A BILL FOR AN ACT

 

 

relating to public safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  (a)  The department of public safety shall establish and maintain a cultural monitor position.  The cultural monitor shall be a full-time position exempt from chapters 76 and 89, Hawaii Revised Statutes.

     (b)  The cultural monitor shall advise the division of corrections on the appropriate enforcement of the right to engage in religious and cultural practices in privately-owned prisons or other out-of-state detention facilities that incarcerate or detain prisoners or detainees pursuant to a contract with the State.

PART II

     SECTION 2.  The auditor shall conduct an audit of the department of public safety's contracts for prison beds and services outside of Hawaii, focusing on the extent to which the constitutional rights of native Hawaiians incarcerated or detained in privately-owned prisons or other out-of-state detention facilities, particularly regarding religion and culture, are safeguarded.

     SECTION 3.  The auditor shall report its findings and recommendations to the legislature no later than twenty days prior to the convening of the 2012 regular session.

PART III

     SECTION 4.  This Act shall take effect upon its approval.
