A BILL FOR AN ACT
RELATING TO EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- Indemnity upon intervening in crime-related incidents; students. The State shall indemnify and hold harmless any department employee intervening in good faith to prevent any act:
(1) By a student enrolled in a public school in the State;
(2) Occurring on or off of school property;
(3) During or after school hours; and
(4) Involving criminal activity;
provided that indemnification shall be from any civil liability that might otherwise be incurred or imposed by, or as a result of, the intervention."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
