A BILL FOR AN ACT
RELATING TO ENERGY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 201N, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§201N- Wind turbines; land use commission review. (a) In addition to any other permit, review, or prerequisite required under this chapter prior to the approval of a permit plan application for a wind turbine, the land use commission, pursuant to section 205- , shall conduct an additional review of each permit plan application for a wind turbine that will:
(1) Generate greater than one hundred kilowatts of energy; and
(2) Be located within three-quarters of a mile of any residential, school, hospital, or business property line.
(b) This section shall not apply to permit plan applications for wind turbines that were approved before July 1, 2015.
(c) As used in this section, "wind turbine" shall have the same meaning as in section 201N-31."
SECTION 2. Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§205- Wind turbines; special review. (a) The land use commission, in coordination with the energy resources coordinator, shall review the permit plan application for any wind turbine subject to section 201N- . In its review, the land use commission, in coordination with the energy resources coordinator, shall consider:
(1) The potential impacts on the community in which the wind turbine is proposed to be located; and
(2) How the permitted use or establishment of the wind turbine conforms to existing State and county land use policies.
(b) As used in this section, "wind turbine" shall have the same meaning as in section 201N-31."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2030.
