A BILL FOR AN ACT

 

 

relating to agriculturAL TOURISM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The chairperson of the board of agriculture shall convene an agricultural tourism task force to examine the feasibility of establishing a policy:

     (1)  Authorizing farmers and cattlemen to conduct agricultural tourism activities on agricultural lands; and

     (2)  Exempting the farmers and cattlemen from county laws relating to the construction of buildings or structures, in furtherance of agricultural tourism activities,

if the farmer or cattleman has operated an agricultural business and paid general excise taxes for at least five consecutive years.

     (b)  The task force shall comprise the:

     (1)  Chairperson of the board of agriculture;

     (2)  Director of business, economic development, and tourism, or the director's designated representative;

     (3)  Chairperson of the Hawaiian homes commission, or the chairperson's designated representative;

     (4)  Executive director of economic development of the city and county of Honolulu, or the executive director's designated representative;

     (5)  Director of finance of the county of Hawaii, or the director's designated representative;

     (6)  Director of economic development of the county of Kauai, or the director's designated representative; and

     (7)  Coordinator of economic development of the county of Maui, or the coordinator's designated representative.

     (b)  The chairperson of the board of agriculture shall serve as the chairperson of the task force and shall invite representatives from the following stakeholders to participate as members:

     (1)  The President of the Hawaii Cattlemen's Council, or the President's designated representative;

     (2)  The Executive Director of the Hawaii Farm Bureau Federation, or the Executive Director's designated representative;

     (3)  The President of Hawaii Farmers Union United, or the President's designated representative;

     (4)  The President of the Chamber of Commerce of Hawaii, or the President's designated representative;

     (5)  The President of the Hawaii Visitors and Convention Bureau, or the President's designated representative;

     (6)  The President of the Hawaii Agritourism Association, or the President's designated representative;

     (7)  One farmer from the general public;

     (8)  One cattleman from the general public; and

     (9)  Any other person that the chairperson of the task force deems advisable for inclusion on the task force.

     (c)  The members of the task force shall serve without compensation but shall be reimbursed for travel and other necessary expenses incurred in the performance of their duties.

     SECTION 2.  The agricultural tourism task force shall submit a written report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2014.

     SECTION 3.  This Act shall take effect upon its approval.
