A BILL FOR AN ACT
relating to hawaiian language immersion programs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 10, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§10- Hawaiian language immersion program commission; establishment. (a) There is established a Hawaiian language immersion program commission to oversee the department of education's allocation and use of revenues derived from the public land trust to fund Hawaiian language immersion programs in the public schools as required by section 302A- . The commission shall be placed within the office of Hawaiian affairs for administrative purposes.
(b) The commission shall consist of five members appointed by the governor and shall be selected as follows:
(1) One from a list of not less than three names submitted by the president of the senate;
(2) One from a list of not less than three names submitted by the speaker of the house of representatives;
(3) One from a list of not less than three names submitted by the office of Hawaiian affairs;
(4) One from a list of not less than three names submitted by the Hawaiian homes commission; and
(5) One from a list of not less than three names submitted by the department of education.
(c) The members of the commission shall serve without compensation, but shall be reimbursed for expenses necessary in the performance of their duties. The members of the commission shall be subject to section 26-34. The commission shall select a chairperson from among its members.
(d) The commission shall submit to the legislature, no later than twenty days prior to the convening of the regular session of 2014, and every year thereafter, a report of its activities.
(e) The commission, without regard to chapter 76, may appoint and terminate an executive director and other additional personnel as are necessary to enable the commission to perform the duties of the commission. The commission may fix the compensation of the executive director and other commission personnel."
SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to subpart C of part II to be appropriately designated and to read as follows:
"§302A- Hawaiian language immersion programs; funding. (a) The department shall annually allocate an amount of funds equal to ten per cent of the department's revenues that are derived from the public land trust and use those allocated funds to fund Hawaiian language immersion programs in the public schools, subject to oversight by the Hawaiian language immersion program commission established under section 10‑ .
(b) The department shall submit annual reports to the Hawaiian language immersion program commission on its allocations and its use of those allocations."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
