A BILL FOR AN ACT

 

 

relating to non-fossil fuels.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§196-      Reporting requirements; distributors.  Not later than thirty days after the end of each fiscal year, each distributor shall submit an annual report to the coordinator on the amount and types of non-fossil fuels that the distributor has sold in the State at wholesale or retail during the previous fiscal year."

     SECTION 2.  Section 103D-412, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  Beginning January 1, 2010, all state and county entities, when purchasing new vehicles, shall seek vehicles with reduced dependence on petroleum-based fuels that meet the needs of the agency.  Priority for selecting vehicles shall be as follows:

     (1)  Electric or plug-in hybrid electric vehicles;

     (2)  Hydrogen or fuel cell vehicles; provided that these types of vehicles shall constitute    per cent of each entity's annual new fleet vehicle purchases;

     (3)  Other alternative fuel vehicles;

     (4)  Hybrid electric vehicles; and

     (5)  Vehicles that are identified by the United States Environmental Protection Agency in its annual "Fuel Economy Leaders" report as being among the top performers for fuel economy in their class."

     SECTION 3.  Section 211F-5.7, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  Moneys in the fund shall be expended by the corporation to[:

     (1)  Provide seed capital for and venture capital investments in private sector and federal projects for research, development, testing, and implementation of the Hawaii renewable hydrogen program, as set forth in section 196-10; and

     (2)  For any other purpose deemed necessary to carry out the purposes of section 196‑10.] provide seed capital for the development of hydrogen infrastructure, including production, storage, and dispensing facilities."

     SECTION 4.  Section 286-45, Hawaii Revised Statutes, is amended to read as follows:

     "§286-45  Records of county finance director.  The director of finance shall file each application received and register the vehicle therein described in a record or book to be kept by the director of finance under the following headings:

     (1)  Vehicle registration number;

     (2)  Name of owner; [and]

     (3)  Vehicle identification number[.];

     (4)  Hydrogen or fuel cell vehicles; and

     (5)  Vehicles retrofitted to operate as hydrogen or fuel cell vehicles.

     The director of finance may microfilm vehicle registration and ownership records which are a year old and may discard the original records.  The director of finance may discard vehicle registration and ownership records which are older than six years.  The director of finance shall submit an annual report to the energy resources coordinator on the number and types of vehicles for which applications are received and registered under the headings for hydrogen or fuel cell vehicles or for vehicles retrofitted to operate as hydrogen or fuel cell vehicles."

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for the State to share in the costs of the new mandates imposed upon the counties, in order to comply with Art. VIII, section 5, of the state constitution.

     The sums appropriated shall be expended by the counties for the purposes of this Act in the following amounts for each of the two fiscal years:

     (1)  City and county of Honolulu       $

     (2)  County of Hawaii

     (3)  County of Kauai

     (4)  County of Maui.

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2015.

Report Title:

Fuel Cell Electric Vehicles; Reporting; Appropriations

 

Description:

Requires fuel distributors to report to the energy resources coordinator on non-fossil fuels sold in the State.  Requires the county finance directors to register vehicles under headings for both hydrogen or fuel cell vehicles and vehicles retrofitted to operate as hydrogen or fuel cell vehicles.  Sets a percentage for government procurements of hydrogen or fuel cell vehicles.  Appropriates moneys to the counties for cost-sharing of the new local mandate.
