A BILL FOR AN ACT

 

 

RELATING TO TRANSPORTATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     Section 1.  The Act is recommended by the governor for immediate passage in accordance with section 9 of article VII of the Constitution of the State of Hawaii.

     SECTION 2.  The legislature finds that the current Daniel K. Inouye International Airport (HNL) Airport Layout Plan (ALP) indicates there are issues related to the airspace regulations which are established by the United States Department of Transportation, Federal Aviation Administration (FAA) under the Code of Federal Regulations, 14 CFR, Chapter 1, Subchapter E, Part 77.

     In addition, all airline operators must consider an emergency flight plan, a one-engine inoperative (OEI) scenario (i.e., engine failure of one of its two engines at the most critical phase of take-off).  Currently, for most airlines using HNL Runway BL (i.e. Terminal Runway, or closest to the airport terminal), this OEI departure path is located directly over the existing gantry cranes at Honolulu Harbor's Sand Island Terminal. 

     These gantry cranes are identified as an obstruction in the navigable airspace above HNL.

     Honolulu Harbor is the port-of-entry for cargo into the State and is being modernized.  The existing gantry cranes at Sand Island will be replaced with taller and wider cranes to accommodate larger container ships that are scheduled to arrive in 2018.  In addition, the Department of Transportation, Harbors Division, is currently undertaking another modernization project for Kapalama Container Terminal (the former Kapalama Military Reservation).  This modernization project includes provisions for the installation of additional gantry cranes to accommodate larger and more efficient container ships at Honolulu Harbor which are expected to arrive at the estimated completion of this project in 2022.  These taller gantry cranes at Honolulu Harbor exacerbate the obstruction concerns relative to the OEI path over Sand Island.

     With the support of the Airlines Committee of Hawaii (ACH), an alternate OEI route north of the Sand Island and Kapalama Container Terminals at Honolulu Harbor has been proposed.  However, it is essential to lower the existing "I Heart Radio" Aerial from 447 to 315 feet to allow for this alternate route around the taller cranes.  The "I Heart Radio" Aerial (approximately 447 tall) owned by iHeartMedia located near Dillingham Boulevard and Kokea Street is also identified as an obstruction in the navigable airspace above HNL.  This tower was constructed in 1985 and has four radio transmitters connected to the antenna tower including three AM stations and one FM station.

     This emergency appropriation is immediately needed to ensure the timely lowering of the tower prior to the arrival and installation of the taller and wider cranes which are expected to arrive in November or December 2018.

     The purpose of this Act is to appropriate general obligation bond funds for the capital improvement project to remove and relocate transmission facilities for the "I Heart Radio" Aerial.  The legislature finds and declares that the appropriation is in the public interest and for the public's health, safety, and general welfare of the State.

     SECTION 3.  The director of finance is authorized to issue general obligation bonds in the sum of $3,000,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2017-2018 for the capital improvement project to finance the cost for plans, land acquisition, design, construction, and equipment for the relocation, in part, of the "I Heart Radio" Aerial located near the Kapalama Canal on Dillingham Boulevard to an appropriate location; provided that such relocation may be done in phases.

     The sums appropriated shall be expended by the department of transportation for the purposes of this Act.

     SECTION 4.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2020, shall lapse as of that date.

     SECTION 5.  This Act shall take effect upon its approval.
