A
RESOLUTION
Creating
the Senate Garnishment Proceedings Study Committee; and for other
purposes.
WHEREAS,
the Georgia General Assembly recognized that large and small businesses are
greatly affected in garnishment proceedings in its passage of 2012 HB 683 and
also recognized that many provisions of Chapter 4 of Title 18 of the Official
Code of Georgia Annotated have not been updated in more than 30 years;
and
WHEREAS,
it would be beneficial to examine the current garnishment process because it
substantially burdens large and small businesses; and
WHEREAS,
2011 SB 11 brought to light many issues regarding the burdens of continuing
garnishment, and stakeholder input would enhance the understanding of issues
concerning garnishments in order to make the process fair and efficient for all
involved; and
WHEREAS,
it is important to determine if changes are needed to the garnishment laws of
this state and to address other related issues to determine whether any of these
issues warrant being addressed through legislation.
NOW,
THEREFORE, BE IT RESOLVED BY THE SENATE that there is created the Senate
Garnishment Proceedings Study Committee to be composed of five members of the
Senate appointed by the President of the Senate. The President of the Senate
shall designate one of the appointees to serve as chairperson of the committee.
The chairperson shall call all meetings of the committee.
BE
IT FURTHER RESOLVED that the committee shall undertake a study of the
conditions, needs, issues, and problems mentioned above or related thereto and
recommend any actions or legislation which the committee deems necessary or
appropriate. The committee may conduct such meetings at such places and at such
times as it may deem necessary or convenient to enable it to exercise fully and
effectively its powers, perform its duties, and accomplish the objectives and
purposes of this resolution. The members of the committee shall receive the
allowances authorized for legislative members of interim legislative committees
but shall receive the same for not more than three days unless an additional two
days are authorized by the President of the Senate. The funds necessary to
carry out the provisions of this resolution shall come from the funds
appropriated to the Senate. In the event that the committee makes a report of
its findings and recommendations for proposed legislation, such report shall be
made no later than January 14, 2013. The committee shall stand abolished on
January 14, 2013.
