BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 7 of Article 7 of Chapter 3 of Title 20 of the Official Code of
Georgia Annotated, relating to HOPE scholarships and grants, so as to limit the
number of Zell Miller Scholars at eligible public postsecondary institutions; to
provide for related matters; to repeal conflicting laws; and for other
purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Part
7 of Article 7 of Chapter 3 of Title 20 of the Official Code of Georgia
Annotated, relating to HOPE scholarships and grants, is amended by revising
subsection (f) of Code Section 20-3-519.2, relating to eligibility requirements
for a HOPE scholarship, as follows:
"(f)(1)
For each semester of eligibility,
students who
meet the qualifications to be Zell Miller
Scholars and
who are attending an eligible private postsecondary
institution shall be awarded an amount in
addition to the HOPE award amount
as
follows:
(1)
If attending an eligible public institution, an amount equal to the difference
between the HOPE award amount and the then current academic year standard
undergraduate tuition amount at the institution to be paid; and
(2)
If attending an eligible private institution, an
amount equal to the difference between the
HOPE award amount and the HOPE tuition payment.
(2)(A)
For eligible public postsecondary institutions, the commission shall annually
determine the number of Zell Miller Scholars who will receive the additional
awards authorized under this paragraph at each such institution by taking the
total number of eligible Zell Miller Scholars in this state and apportioning
such number pro rata based upon undergraduate enrollment in each such eligible
public postsecondary institution. The number so derived shall be the maximum
number of Zell Miller Scholars who are eligible for the additional award under
subparagraph (B) of this paragraph at such institution for that academic year.
If there are more Zell Miller Scholars attending such institution than the
eligible public postsecondary institution is authorized for under this
subparagraph, then such institution shall determine by lot which of the eligible
students shall receive the additional award under this paragraph.
(B)
For each semester of eligibility, students who meet the qualifications to be
Zell Miller Scholars who are attending an eligible public postsecondary
institution and who are authorized to receive the additional award under
subparagraph (A) of this paragraph shall be awarded an amount in addition to the
HOPE award amount equal to the difference between the HOPE award amount and the
then current academic year standard undergraduate tuition amount at the eligible
public postsecondary
institution."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
