A BILL TO BE ENTITLED
AN ACT

To amend Article 1 of Chapter 5 of Title 12 of the Official Code of Georgia Annotated, relating to general provisions relative to water resources, so as to exempt water withdrawals from a certain portion of the Tennessee River basin from restrictions on transfers of water; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.

Article 1 of Chapter 5 of Title 12 of the Official Code of Georgia Annotated, relating to general provisions relative to water resources, is amended by adding a new Code section to read as follows:

"12-5-10.

The withdrawal of surface water from any point within that portion of the Tennessee River basin lying in the Chickamauga Valley and Lookout Mountain physiographic districts in this state followed by use or return of some or all of that water to a different river basin in this state shall be exempt from any restriction on transfers of water provided by or pursuant to any provision of this chapter."

SECTION 2.

All laws and parts of laws in conflict with this Act are repealed.
