The House Committee on Judiciary Non-civil offers the following substitute to SB
225:

BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 10 of Title 16 of the Official Code of Georgia
Annotated, relating to obstruction of public administration and related criminal
offenses, so as to provide for a new offense of transmitting a false report of a
crime; to provide for a penalty; to provide for related matters; to provide for
an effective date and applicability; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 10 of Title 16 of the Official Code of Georgia Annotated, relating
to obstruction of public administration and related criminal offenses, is
amended by adding a new Code section to read as follows:
"16-10-26.1.
(a)
As used in this Code section, the term 'serious violent felony' shall have the
same meaning as set forth in Code Section 17-10-6.1.
(b)
A person who knowingly and intentionally transmits a false claim by means of a
written, electronic, or other transmission, through any medium, stating that he
or she has committed a serious violent felony and the false claim is made with
the intent to cause a law enforcement agency or official to initiate an
investigation to determine whether such serious violent felony has been
committed by such person shall be guilty of the misdemeanor offense of
transmitting a false report of a
crime."
SECTION
2.
This
Act shall become effective on July 1, 2012, and shall apply to offenses
committed on or after such date.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
