A BILL TO BE ENTITLED
AN ACT


To amend Code Section 16-5-95 of the Official Code of Georgia Annotated, relating to the offense of violating family violence orders and penalty, so as to provide that a person who seeks and obtains a family violence order violates such order by engaging in certain activity; to provide a penalty; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 16-5-95 of the Official Code of Georgia Annotated, relating to the offense of violating family violence orders and penalty, is amended by adding a new subsection to read as follows:
"(a.1) A person who seeks and is granted a family violence order violates such order when he or she commits any act which would place the person named in the order in violation if that person had committed such act."

SECTION 2.
Said Code section is further amended by revising subsection (b) as follows:
"(b) Any person convicted of a violation of subsection (a) or (a.1) of this Code section shall be guilty of a misdemeanor."

SECTION 3.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
