A BILL TO BE ENTITLED
AN ACT


To amend Article 5 of Chapter 3 of Title 47 of the Official Code of Georgia Annotated, relating to service creditable under the Teachers Retirement System of Georgia, so as to provide for creditable service for prior service as a member of the Trial Judges and Solicitors Retirement Fund; to provide for the payment of an employee contribution; to provide for application; to provide for related matters; to provide conditions for an effective date and automatic repeal; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 5 of Chapter 3 of Title 47 of the Official Code of Georgia Annotated, relating to service creditable under the Teachers Retirement System of Georgia, is amended by adding a new Code section to read as follows:
"47-3-96.
Any member of the retirement system shall be entitled to receive up to ten years of creditable service for prior service as a member of the Trial Judges and Solicitors Retirement Fund as such retirement fund existed prior to July 1, 1998. A member desiring to establish credit for such service shall pay employee contributions which would have been paid to the retirement system on a salary comparable to his or her salary at the time of application, plus regular interest thereon, in accordance with regulations adopted by the board of trustees. No member who receives or who is entitled to receive a pension or annuity from any other public retirement system, excluding social security, based upon such prior service shall receive creditable service for such service. Any member desiring to obtain creditable service pursuant to the provisions of this Code section shall make application to the board of trustees and pay all amounts required not later than December 31, 2010, and provide such proof of prior employment as the board deems appropriate. The board of trustees shall promulgate rules and regulations necessary to carry out the provisions of this Code section."
SECTION 2.
This Act shall become effective on July 1, 2010, only if it is determined to have been concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not become effective and shall be automatically repealed in its entirety on July 1, 2010, as required by subsection (a) of Code Section 47-20-50.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
