A BILL TO BE ENTITLED
AN ACT


To amend an Act providing for the compensation of certain county officers and officials of DeKalb County, approved March 31, 1976 (Ga. L. 1976, p. 3986), as amended, particularly by an Act approved May 6, 2005 (Ga. L. 2005, p. 3779), so as to change certain provisions relating to the compensation of the sheriff; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act providing for the compensation of certain county officers and officials of DeKalb County, approved March 31, 1976 (Ga. L. 1976, p. 3986), as amended, particularly by an Act approved May 6, 2005 (Ga. L. 2005, p. 3779), is amended by revising Section 2 to read as follows:

"SECTION 2.
Notwithstanding any other provisions of law to the contrary, the annual salary of each of the officials of DeKalb County listed below shall be the following percentages of the gross salary as defined in Section 1:
(1) Judge of the Probate Court
85%
(2) Clerk of the Superior Court
75%
(3) Tax commissioner
75%
(4) Judge of the Juvenile Court
90%
(5) Sheriff
65%"

SECTION 2.
Said Act is further amended by revising Section 2.2 to read as follows:

"SECTION 2.2.
(a) Notwithstanding any other provisions of law to the contrary, the annual salary of the sheriff of DeKalb County shall be the greater of that annual salary provided for in Section 2 of this Act or $140,000.00.
(b) In addition to the compensation provided for in subsection (a) of this Section, the sheriff of DeKalb County shall also be entitled to any other compensation or salary increase as provided for by law, including, but not limited to, any cost-of-living increase provided to state employees and any increase for being reelected to serve a new four-year term as sheriff."

SECTION 3.
This Act shall become effective on January 1, 2010.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
