The
House Committee on Judiciary Non-civil offers the following substitute to HB
71:

BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 16-9-4 of the Official Code of Georgia Annotated, relating to
manufacturing, selling, or distributing false identification documents, so as to
remove a defense to a charge of manufacturing, selling, or distributing false
identification documents; to provide for related matters; to provide for an
effective date and applicability; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 16-9-4 of the Official Code of Georgia Annotated, relating to
manufacturing, selling, or distributing false identification documents, is
amended by revising subsection (g) as follows:
"(g)
It shall not be a defense to a violation of this Code section that a document
contained words indicating that it is not an identification document
unless
there appears on the front and back of such document the word 'novelty' which is
in a color which is not transparent on the design of the document, is in block
letters not less than 40 point type in size, and is indelible
ink."
SECTION
2.
This
Act shall become effective on October 1, 2009, and shall apply to offenses
committed on or after such date.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
