A BILL TO BE ENTITLED
AN ACT


To amend Code Section 45-20-16 of the Official Code of Georgia Annotated, relating to rules for accrual of leave, holidays, and compensation for closing of state offices, so as to provide for the accrual of leave during a furlough period; to provide a definition; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 45-20-16 of the Official Code of Georgia Annotated, relating to rules for accrual of leave, holidays, and compensation for closing of state offices, is amended by revising subsection (a) as follows:
"(a) As a part of employee compensation, the State Personnel Board shall establish rules for the accrual and usage of leave and holidays and for compensation due to emergency closure of state offices or facilities for nontemporary employees. All agencies of the executive branch, exclusive of the Board of Regents of the University System of Georgia, shall provide for the accrual and usage of leave and holidays and for compensation due to emergency closure of state offices or facilities for nontemporary employees in accordance with State Personnel Board rules. On a day or period during which an employee is furloughed, the employee shall continue to accrue leave, including sick leave and annual leave, in the same manner as such leave is accrued on nonfurloughed days. For purposes of this subsection, the term 'furlough' means a period of time during which an employee is involuntarily and without cause placed on leave without pay."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
