House Committee on Budget & Fiscal Affairs Oversight offers the following
substitute to HB 669:
A
BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 4 of Title 50 of the Official Code of Georgia Annotated, relating
to the organization of the executive branch generally, so as to require the
Department of Audits and Accounts to report federal funds received by certain
state agencies; to provide for definitions; to provide for submittal of a report
to legislative appropriations committees; to provide for legislative
recommendations; to provide for a legislative study regarding additional
reporting; to provide for related matters; to repeal conflicting laws; and for
other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
4 of Title 50 of the Official Code of Georgia Annotated, relating to the
organization of the executive branch generally, is amended by adding a new Code
section to read as follows:
"50-4-8.
(a)
As used in this Code section, the term:
(1)
'Designated state agency' means the Department of Administrative Services, the
Department of Agriculture, the Department of Revenue, the Department of
Community Affairs, the Department of Corrections, the Department of Natural
Resources, the Department of Banking and Finance, the Department of Public
Health, the Department of Community Health, the Department of Behavioral Health
and Developmental Disabilities, the Department of Human Services, the Department
of Insurance, the Department of Public Safety, the Department of Transportation,
the Department of Veterans Service, the Department of Labor, the Department of
Economic Development, the Public Service Commission, the Board of Regents of the
University System of Georgia, the Technical College System of Georgia, the
Department of Education, and the Department of Defense.
(2)
'Federal revenue' means federal funds received by a state agency.
(b)(1)
The Department of Audits and Accounts shall prepare a report that:
(A)
Reports the aggregate value of federal revenue each designated state agency
received for the preceding fiscal year;
(B)
Reports the aggregate amount of federal funds appropriated by the legislature to
each designated state agency for the preceding fiscal year; and
(C)
Calculates the percentage of each designated state agency's total budget for the
preceding fiscal year that constitutes all federal revenue and federal funds
appropriated by the legislature that such designated state agency received for
that fiscal year.
(2)
The report required by paragraph (1) of this subsection with respect to the
board of regents shall include the information required by subparagraphs (A)
through (C) of paragraph (1) of this subsection for each state institution of
higher education.
(c)
The Department of Audits and Accounts shall submit the report required by
subsection (b) of this Code section to the Appropriations Committees of the
Senate and the House of Representatives on or before the first day of the
regular session of the General Assembly of each year.
(d)
Upon receipt of the report required by subsection (b) of this Code section, the
chairpersons of the Appropriations Committees of the Senate and the House of
Representatives shall place the report on the agenda for review and
consideration at the next meeting of the Appropriations Committees of the Senate
and the House of Representatives, respectively.
(e)
When considering the report required by subsection (b) of this Code section, the
Appropriations Committees of the Senate and the House of Representatives may
elect to:
(1)
Recommend that the legislature reduce or eliminate appropriations for a
designated state agency;
(2)
Take no action; or
(3)
Take another action that a majority of the committee approves.
(f)
During the 2012 interim, the Senate Government Oversight Committee and the House
Committee on Governmental Affairs shall jointly study whether to draft and
propose legislation requiring:
(1)
A political subdivision to:
(A)
Calculate the aggregate value of federal revenue the political subdivision
receives;
(B)
Calculate the percentage of the political subdivision's total budget that
constitutes federal revenue; and
(C)
Develop a plan for operating the political subdivision if there is a reduction
of:
(i)
Five percent or more in the federal revenue that the political subdivision
receives; and
(ii)
Twenty-five percent or more in the federal revenue that the political
subdivision receives;
(2)
A state institution of higher education or a school within the public education
system to develop a plan for operating the state institution of higher education
or the school if there is a reduction of:
(A)
Five percent or more in the federal revenue that the state institution of higher
education or school receives; and
(B)
Twenty-five percent or more in the federal revenue that the state institution of
higher education or school receives; or
(3)
A designated state agency to develop plans for operating the designated state
agency if there is a reduction of:
(A)
Five percent or more in the federal revenue that the designated state agency
receives; and
(B)
Twenty-five percent or more in the federal revenue that the designated state
agency receives."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
