BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act creating the State Court of Cobb County, approved March 26, 1964
(Ga. L. 1964, p. 3211), as amended, particularly by an Act approved April 27,
2001 (Ga. L. 2001, p. 4490), so as to authorize the court to charge a technology
fee for each civil case filed, each criminal fine imposed, and each traffic case
fined; to specify the uses to which said technology fees may be put; to provide
an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act creating the State Court of Cobb County, approved March 26, 1964 (Ga. L.
1964, p. 3211), as amended, particularly by an Act approved April 27, 2001 (Ga.
L. 2001, p. 4490), is amended by designating the existing text of Section 20 as
subsection (a) and adding a new subsection (b) to read as follows:
"(b)
The clerk of the state court shall be entitled to charge and collect a
technology fee to be set by the court not to exceed $15.00 for the filing of
each civil case filed, each criminal fine imposed, and each traffic case fined
as a surcharge to each. Such technology fee shall be used exclusively to
provide for the technological needs of all county court systems, to include only
the following uses: computer hardware and software purchases, leases,
maintenance, and installation; imaging, scanning, facsimile, communications,
projection, and printing equipment and software purchases, leases, maintenance,
and installation; and associated personal technology services. The funds
collected pursuant to this subsection shall be maintained in a segregated fund
by the Cobb County Finance Department and shall be used only for the purposes
authorized in this subsection through the budget appropriation process of the
county."
SECTION
2.
This
Act shall become effective on July 1, 2011.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
