BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act to create and incorporate the City of Denton in the County of Jeff
Davis and grant a charter to that municipality under that name and style,
approved February 28, 1966 (Ga. L. 1966, p. 2352), so as to revise the
manner of filling vacancies; to provide for submission under Section 5 of the
federal Voting Rights Act of 1965, as amended; to provide for related matters;
to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act to create and incorporate the City of Denton in the County of Jeff Davis and
grant a charter to that municipality under that name and style, approved
February 28, 1966 (Ga. L. 1966, p. 2352), is amended by revising
Section 8 as follows:
"SECTION
8.
(a)
Should the mayor or any member of the city council fail or refuse to perform the
duties of his or her office for the term of three consecutive months, or should
any officer-elect refuse to qualify, the office may be, in the discretion of the
remaining members of the city council, declared vacant and the vacancy filled as
provided in this section.
(b)
In the event of a vacancy in the office of mayor or councilmember and there is
one year or less remaining in such person's term of office, the city council or
those remaining shall appoint a qualified individual to fill the balance of the
unexpired term of such person. In the event that there is more than one year
remaining in such person's term of office, the vacancy shall be filled by
special election called and held in accordance with Code Section 21-2-540
of the O.C.G.A. In the event that all seats on the city council are vacant,
such vacancies shall be filled in accordance with the provisions of Code
Section 36-30-13 of the O.C.G.A."
SECTION
2.
The
governing authority of the City of Denton shall through its legal counsel cause
this Act to be submitted for preclearance under the federal Voting Rights Act of
1965, as amended, no later than 45 days after the date on which this Act is
approved by the Governor or otherwise becomes law without such
approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
