A BILL TO BE ENTITLED
AN ACT


To provide for certain rights, powers, and privileges of the Newton County Industrial Development Authority; to define a term; to repeal certain Acts related to the authority; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
(a) The Newton County Industrial Development Authority, created by an amendment to the Constitution of 1945 (Resolution Act No. 112, House Resolution No. 414-937, Ga. L. 1964, p. 825) and continued in effect by Act of the General Assembly approved March 28, 1985 (Act No. 497, House Bill 986, Ga. L. 1985, p. 4932), is granted all of the rights, powers, and privileges granted to:
(1) A development authority created pursuant to Chapter 62 of Title 36 of the Official Code of Georgia, the "Development Authorities Law," as now or hereafter amended; and
(2) A governmental body under and pursuant to Article 3 of Chapter 82 of Title 36 of the Official Code of Georgia, the "Revenue Bond Law," as now or hereafter amended,
which rights, powers, and privileges shall be in addition to, and shall not limit or restrict in any respect, the rights, powers, and privileges currently held by the authority pursuant to that constitutional amendment which created the authority. In such regard, the authority shall be authorized to exercise any right, power, or privilege granted a development authority under the Development Authorities Law or a governmental body under the Revenue Bond Law in addition to, and not in limitation of, the powers granted to the authority pursuant to that constitutional amendment which created the authority.
(b) As used in that constitutional amendment which created the authority, the term "project" means and includes:
(1) The acquisition, construction, installation, modification, renovation, or rehabilitation of land, buildings, structures, facilities, improvements, or any other real property located or to be located within Newton County or any interest in any of the foregoing;
(2) The acquisition, installation, modification, renovation, rehabilitation, or furnishing of fixtures, machinery, equipment, furniture, and other personal property of any nature whatsoever;
(3) Any undertaking as such term is used in the Revenue Bond Law; or
(4) Any combination of the foregoing,
all for the essential public purpose of promoting and expanding the public good and welfare and industry and trade within Newton County and reducing unemployment to the greatest extent possible. A project may be for any industrial, commercial, business, office, retail, public, or other use, including, without limitation, the uses specifically described under the definition of "project" in the Development Authorities Law, provided that a majority of the members of the authority determine, by a resolution duly adopted, that the project and such use thereof would further the public purposes for which the Authority was created.
(c) In addition, the authority shall have the power to contract for any period not exceeding 50 years with Newton County, Georgia, or any or all municipal corporations and other political subdivisions situated therein, or any other public agency, public corporation, or public authority, or any combination thereof (collectively, the "public entities") in connection with any activities, services, or facilities which the contracting parties are authorized to undertake or provide.

SECTION 2.
The following Acts are hereby repealed:
(1) An Act to provide additional powers, duties, rights, obligations, and responsibilities for the Newton County Industrial Development Authority, approved April 6, 1981 (Ga. L. 1981, p. 3302); and
(2) An Act to amend an Act to provide additional powers, duties, rights, obligations, and responsibilities for the Newton County Industrial Development Authority, approved March 27, 1991 (Ga. L. 1991, p. 3529).

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
