BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 15 of Title 45 of the Official Code of Georgia Annotated, relating
to the Attorney General, so as to provide for certain requirements relating to
the Attorney General's authorization to employ private counsel; to provide for
related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
15 of Title 45 of the Official Code of Georgia Annotated, relating to the
Attorney General, is amended by revising Code Section 45-15-4, relating to the
Attorney General's authorization to employ private counsel, as
follows:
"45-15-4.
(a)
The Attorney General, upon the request of any department, office, officer,
institution, commission, committee, board, or other agency of any branch of the
government of the state or any instrumentality thereof,
is
shall
be authorized to select and employ private
counsel to perform legal services for such department, office, officer,
institution, commission, committee, board, or other agency of any branch of the
government of the state or any instrumentality thereof.
(b)
Copies of any contract for services executed between the Attorney General and
private counsel pursuant to this Code section shall be posted on the Attorney
General's website for public inspection within five business days after the date
the contract is executed and shall remain on the website for the duration of the
contract, including any extensions or amendments to the contract. Any payment
of fees pursuant to such contracts shall be posted on the Attorney General's
website within 15 days after the payment of such fees to the private attorney
and shall remain posted on the website for at least 365 days
thereafter."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
