BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 1 of Title 42 of the Official Code of Georgia
Annotated, relating to the sexual offender registration review board, so as to
provide that persons who are required to register on the state sexual offender
registry are prohibited from photographing a minor without the permission of the
minor's parent; to provide an effective date; to repeal conflicting laws; and
for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 1 of Title 42 of the Official Code of Georgia Annotated, relating
to the sexual offender registration review board, is amended by revising Code
Section 42-1-18, relating to the definition of "photograph," photographing a
minor without consent of parent or guardian prohibited, and penalty, as
follows:
"42-1-18.
(a)
As used in this Code section, the term 'photograph' means to take any picture,
film or digital photograph, motion picture film, videotape, or similar visual
representation or image of a person.
(b)
No
individual
person
required to register as a sexual offender pursuant to Code Section
42-1-12 shall intentionally photograph a
minor without the consent of the minor's parent or guardian.
(c)
Any
individual
person
who knowingly violates this Code section shall be guilty of a misdemeanor of a
high and aggravated nature."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
