BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 2 of Title 40 of the Official Code of Georgia
Annotated, relating to registration and licensing of motor vehicles generally,
so as to provide for a temporary registration for certain motor vehicles under
certain circumstances; to provide for the manner of issuance, length, and
conditions of such temporary registration; to provide for related matters; to
provide an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 2 of Title 40 of the Official Code of Georgia Annotated, relating
to registration and licensing of motor vehicles generally, is amended by adding
a new Code section to read as follows:
"40-2-20.1.
(a)
An owner of a motor vehicle that is required to be registered with the county
tag agent in a county in which the owner of the vehicle is required to submit a
valid certificate of emission inspection demonstrating that the vehicle passed
an emission inspection shall be eligible for a temporary registration and
operation permit if the owner is unable to pass a vehicle emission inspection
before the expiration of the vehicle's current registration due to the need for
repairs on the vehicle or the need for a period of operation of the vehicle to
ready the vehicle for emission testing.
(b)
Such temporary registration and operation permits shall be issued by the county
tag agent upon application by the owner of the motor vehicle and the payment of
all taxes and fees that would be due at the time of registration along with a
fee of $10.00 for the temporary registration and operation permit, provided that
the motor vehicle meets all other requirements for registration except for the
submission of a valid certificate of emission inspection; and the attestation by
the owner of the vehicle that such emission certificate could not be obtained by
the expiration of the current registration period due to the need for repairs on
the vehicle or the need for a period of operation of the vehicle to ready the
vehicle for emission testing.
(c)
Such temporary registration and operation permit shall be issued by the county
tag agent and shall be valid for a period not to exceed 15 days from the date of
issue and shall extend the vehicle registration period for the vehicle for the
duration of the period for which the temporary registration and operation permit
is issued.
(d)
Only one temporary registration and operation permit shall be issued for a motor
vehicle in a calendar year.
(e)
Upon the submission of a valid certificate of emission inspection report prior
to the expiration of the temporary registration and operation permit, the tag
agent shall be authorized to issue a new license plate or revalidation decal to
the owner of the motor
vehicle."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
