BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 2 of Article 2 of Chapter 4 of Title 38 of the Official Code of
Georgia Annotated, relating to war veterans homes, so as to require the Veterans
Service Board to apply for certification for the Georgia State War Veterans'
Home to participate in the medicare and Medicaid programs; to provide for
payment to the Department of Veterans Service from third-party payers; to
provide for related matters; to provide for an effective date; to repeal
conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Part
2 of Article 2 of Chapter 4 of Title 38 of the Official Code of Georgia
Annotated, relating to war veterans homes, is amended by adding a new Code
section to read as follows:
"38-4-56.
(a)
No later than July 1, 2012, the Veterans Service Board shall submit an
application to the federal Centers for Medicare and Medicaid Services (CMS) to
obtain approval for certification for the Georgia State War Veterans' Home to
participate in the medicare and Medicaid programs. Upon approval by CMS to
participate in such programs, the Veterans Service Board shall utilize such
programs as funding sources for paying a portion of the operating costs for the
facilities of the Georgia State War Veterans' Home.
(b)
The Department of Veterans Service is authorized to collect any moneys from
veteran patients of the Georgia State War Veterans' Home directly or indirectly
through a third-party payer, including Medicaid and medicare, or to receive the
assignment of any third-party payer benefits by veteran
patients."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
