Florida Senate - 2012 (PROPOSED COMMITTEE BILL) SPB 7062 FOR CONSIDERATION By the Committee on Budget 576-01656A-12 20127062__ 1 A bill to be entitled 2 An act relating to the Department of Health; amending 3 s. 945.602, F.S.; assigning, for administrative 4 purposes, the Correctional Medical Authority to the 5 Executive Office of the Governor, rather than the 6 Department of Health; conforming provisions to changes 7 made by the act; deleting an obsolete provision; 8 providing for a transfer of the administration of the 9 Correctional Medical Authority from the Department of 10 Health to the Executive Office of the Governor; 11 providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Subsections (1) and (3) of section 945.602, 16 Florida Statutes, are amended to read: 17 945.602 State of Florida Correctional Medical Authority; 18 creation; members.— 19 (1) There is created the State of Florida Correctional 20 Medical Authority, which for administrative purposes shall be 21 assigned to the Executive Office of the GovernorDepartment of22Health. The governing board of the authority shall be composed 23 of nine persons appointed by the Governor subject to 24 confirmation by the Senate. One member must be a member of the 25 Florida Hospital Association; one member must be a member of the 26 Florida League of Hospitals; one member must be a member of the 27 Association of Community Hospitals and Health Systems of 28 Florida; and one member must be a member of the Florida Medical 29 Association. The authority shall contract with the Executive 30 Office of the GovernorDepartment of Healthfor the provision of 31 administrative support services, including purchasing, 32 personnel, general services, and budgetary matters. The 33 authority isshallnotbesubject to control, supervision, or 34 direction by the Executive Office of the GovernorDepartment of35Healthor the Department of Corrections. The authority shall 36 annually elect one member to serve as chair. Members shall be 37 appointed for terms of 4 years each. Each member mayis38authorized tocontinue to serve upon the expiration of his or 39 her term until a successor is duly appointed as provided in this 40 section. Before entering upon his or her duties, each member of 41 the authority shall take and subscribe to the oath or 42 affirmation required by the State Constitution. 43 (3)Effective for new appointments after July 1, 1996,At 44 least one member of the authority must be a physician licensed 45 under chapter 458, and one member of the authority may be a 46 physician licensed under chapter 458 or chapter 459. At least 47 two other members of the authority must have had at least 5 48 years’ experience in health care administration. 49 Section 2. All powers, duties, functions, records, offices, 50 personnel, associated administrative support positions, 51 property, pending issues, existing contracts, administrative 52 authority, and administrative rules relating to the State of 53 Florida Correctional Medical Authority in the Department of 54 Health are transferred to the Executive Office of the Governor. 55 Section 3. This act shall take effect July 1, 2012.
