    1                        A bill to be entitled                      
    2         An act relating to a review under the Open Government
    3         Sunset Review Act; amending s. 601.76, F.S., which
    4         provides an exemption from public records requirements
    5         for a manufacturer’s formula filed with the Department
    6         of Agriculture and Consumer Services; removing the
    7         scheduled repeal of the exemption; providing an
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 601.76, Florida Statutes, is amended to
   13  read:
   14         601.76 Manufacturer to furnish formula and other
   15  information.—Any formula required to be filed with the
   16  Department of Agriculture shall be deemed a trade secret as
   17  defined in s. 812.081, is confidential and exempt from s.
   18  119.07(1) and s. 24(a), Art. I of the State Constitution, and
   19  may be divulged only to the Department of Agriculture or to its
   20  duly authorized representatives or upon court order when
   21  necessary in the enforcement of this law. A person who receives
   22  such a formula from the Department of Agriculture under this
   23  section shall maintain the confidentiality of the formula. This
   24  section is subject to the Open Government Sunset Review Act in
   25  accordance with s. 119.15 and shall stand repealed on October 2,
   26  2021, unless reviewed and saved from repeal through reenactment
   27  by the Legislature.
   28         Section 2. This act shall take effect October 1, 2021.
