1 A bill to be entitled
2 An act relating to administration of vaccines;
3 amending s. 465.014, F.S.; specifying training
4 requirements for registered pharmacy technicians
5 seeking to administer certain vaccines; providing
6 requirements for such training; requiring such
7 registered pharmacy technicians to complete certain
8 additional continuing education as a condition of
9 registration renewal; amending s. 465.189, F.S.;
10 authorizing certified registered pharmacy technicians
11 to administer specified immunizations and vaccines
12 under certain circumstances; revising the specified
13 immunizations and vaccines that certified pharmacists,
14 registered interns, and registered pharmacy
15 technicians may administer; revising a certain
16 staffing ratio for supervising pharmacists; requiring
17 pharmacists to maintain certain liability insurance in
18 a specified amount in order to administer
19 immunizations and vaccines; specifying certification
20 requirements for registered pharmacy technicians
21 seeking to administer immunizations and vaccines;
22 providing an effective date.

24 Be It Enacted by the Legislature of the State of Florida:
25
26 Section 1. Present subsections (7) and (8) of section
27 465.014, Florida Statutes, are redesignated as subsections (8)
28 and (9), respectively, and a new subsection (7) is added to that
29 section, to read:
30 465.014 Pharmacy technician.—
31 (7) A registered pharmacy technician seeking to administer
32 vaccines under s. 465.189 must be certified to administer such
33 vaccines pursuant to a certification program approved by the
34 board in consultation with the Board of Medicine and the Board
35 of Osteopathic Medicine. The certification program must have at
36 least 10 hours of immunization-related training approved by the
37 board which must, at a minimum, have a curriculum of instruction
38 concerning the safe and effective administration of such
39 vaccines, including, but not limited to, potential allergic
40 reactions to such vaccines, first-aid training, and
41 cardiopulmonary resuscitation training. As a condition of
42 registration renewal, a registered pharmacy technician seeking
43 to administer vaccines under s. 465.189 must have at least 2
44 hours of continuing education approved by the board relating to
45 the certification program training, in addition to the biennial
46 continuing education required in subsection (6).
47 Section 2. Subsections (1), (4), (5), and (7) of section
48 465.189, Florida Statutes, are amended to read:
49 465.189 Administration of vaccines and epinephrine
50 autoinjection.—
51 (1) In accordance with guidelines of the Centers for
52 Disease Control and Prevention for each recommended immunization
53 or vaccine, a pharmacist who is certified under subsection (7),
54 or a registered intern or registered pharmacy technician who is
55 under the supervision of a pharmacist and who is certified under
56 subsection (7), may administer the following immunizations or
57 vaccines to an adult within the framework of an established
58 protocol under a supervising physician licensed under chapter
59 458 or chapter 459:
60 (a) Immunizations or vaccines listed in the Adult
61 Immunization Schedule as of March 11, 2022 April 30, 2021, by
62 the United States Centers for Disease Control and Prevention.
63 The board may authorize by rule additional immunizations or
64 vaccines as they are added to the Adult Immunization Schedule.
65 (b) Immunizations or vaccines recommended by the United
66 States Centers for Disease Control and Prevention for
67 international travel as of March 11, 2022 April 30, 2021. The
68 board may authorize by rule additional immunizations or vaccines
69 as they are recommended by the United States Centers for Disease
70 Control and Prevention for international travel.
71 (c) Immunizations or vaccines licensed for use in the
72 United States, or which have been authorized for emergency use,
73 by the United States Food and Drug Administration as of March
74 11, 2022 April 30, 2021. The board may authorize by rule
75 additional immunizations or vaccines as they are so licensed or
76 authorized.
77 (d) Immunizations or vaccines approved by the board in
78 response to a state of emergency declared by the Governor
79 pursuant to s. 252.36.

81 A registered intern or registered pharmacy technician who
82 administers an immunization or vaccine under this subsection
83 must be supervised by a certified pharmacist at a ratio of one
84 pharmacist to one registered intern or registered pharmacy
85 technician.
86 (4) A pharmacist may not enter into a protocol under a
87 supervising physician licensed under chapter 458 or chapter 459
88 or administer an immunization or vaccine under this section
89 unless he or she maintains at least $200,000 of professional
90 liability insurance and has completed training in administering
91 vaccines authorized under this section.
92 (5) A pharmacist administering immunizations or vaccines
93 under this section shall maintain and make available patient
94 records using the same standards for confidentiality and
95 maintenance of such records as those that are imposed on health
96 care practitioners under s. 456.057. These records shall be
97 maintained for a minimum of 5 years.
98 (7) Any pharmacist, or registered intern, or registered
99 pharmacy technician seeking to administer immunizations and
100 vaccines under this section must be certified to administer such
101 immunizations and vaccines pursuant to a certification program
102 approved by the board of Pharmacy in consultation with the Board
103 of Medicine and the Board of Osteopathic Medicine. The
104 certification program must shall, at a minimum, require that the
105 pharmacist attend at least 20 hours of continuing education
106 classes approved by the board, and the registered intern
107 complete at least 20 hours of coursework approved by the board,
108 and the registered pharmacy technician complete immunization
109 related training and continuing education as specified in s.
110 465.014(7). The certification programs must, at a minimum,
111 program shall have a curriculum of instruction concerning the
112 safe and effective administration of such immunizations and
113 vaccines, including, but not limited to, potential allergic
114 reactions to such vaccines.
115 Section 3. This act shall take effect July 1, 2022.
