    1                        A bill to be entitled                      
    2         An act relating to correctional officers; providing
    3         legislative intent; amending s. 943.10, F.S.; revising
    4         the definition of the term “correctional officer”;
    5         providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. The intent of this act is to afford a
   10  correctional officer the benefits of the federal Law Enforcement
   11  Officers Safety Act relating to the carrying of concealed
   12  firearms by revising the definition of the term “correctional
   13  officer” to conform to the definition of the term “qualified law
   14  enforcement officer” as it is used in the federal act.
   15         Section 2. Subsection (2) of section 943.10, Florida
   16  Statutes, is amended to read:
   17         943.10 Definitions; ss. 943.085-943.255.—The following
   18  words and phrases as used in ss. 943.085-943.255 are defined as
   19  follows:
   20         (2) “Correctional officer” means any person who is
   21  appointed or employed full time by the state or any political
   22  subdivision thereof, or by any private entity which has
   23  contracted with the state or county, and whose primary
   24  responsibility is the supervision, protection, care, custody,
   25  and control, or investigation, of inmates within a correctional
   26  institution; however, the term “correctional officer” does not
   27  include any secretarial, clerical, or professionally trained
   28  personnel. A correctional officer is vested with the authority
   29  to bear arms.
   30         Section 3. This act shall take effect July 1, 2018.
