Florida Senate - 2016 CS for SB 1636 By the Committee on Ethics and Elections; and Senator Gibson 582-03673-16 20161636c1 1 A bill to be entitled 2 An act relating to duties of the Legislative Auditing 3 Committee; amending s. 11.45, F.S.; removing a 4 requirement that the Auditor General notify the 5 committee regarding certain financial or operational 6 audit reports of state universities or Florida College 7 System institutions; removing duties of the committee 8 relating to state universities or Florida College 9 System institutions that have failed to take 10 corrective action based on such reports; amending s. 11 215.985, F.S.; repealing provisions requiring the 12 committee’s input related to the website of the 13 Executive Office of the Governor; providing an 14 effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Paragraph (j) of subsection (7) of section 19 11.45, Florida Statutes, is amended to read: 20 11.45 Definitions; duties; authorities; reports; rules.— 21 (7) AUDITOR GENERAL REPORTING REQUIREMENTS.— 22 (j) The Auditor General shall notify the Legislative 23 Auditing Committee of any financial or operational audit report 24 prepared pursuant to this section which indicates that a 25 district school board, state university, or Florida College26System institutionhas failed to take full corrective action in 27 response to a recommendation that was included in the two 28 preceding financial or operational audit reports. 29 1. The committee may direct the district school boardor30the governing body of the state university or Florida College31System institutionto provide a written statement to the 32 committee explaining why full corrective action has not been 33 taken or, if the district school boardgoverning bodyintends to 34 take full corrective action, describing the corrective action to 35 be taken and when it will occur. 36 2. If the committee determines that the written statement 37 is not sufficient, the committee may require the chair of the 38 district school boardor the chair of the governing body of the39state university or Florida College System institution,or the 40 chair’s designee,to appear before the committee. 41 3. If the committee determines that the district school 42 board, state university, or Florida College System institution43 has failed to take full corrective action for which there is no 44 justifiable reason or has failed to comply with committee 45 requests made pursuant to this section, the committee shall 46 refer the matter to the State Board of Educationor the Board of47Governors, as appropriate,to proceed in accordance with s. 48 1008.32or s. 1008.322, respectively. 49 Section 2. Subsections (2), (7), (8), (9), and (13) of 50 section 215.985, Florida Statutes, are amended to read: 51 215.985 Transparency in government spending.— 52 (2) As used in this section, the term: 53(a)“Committee” means the Legislative Auditing Committee54created in s. 11.40.55 (a)(b)“Contract” means a written agreement or purchase 56 order issued for the purchase of goods or services or a written 57 agreement for the receipt of state or federal financial 58 assistance. 59 (b)(c)“Governmental entity” means a state, regional, 60 county, municipal, special district, or other political 61 subdivision whether executive, judicial, or legislative, 62 including, but not limited to, a department, division, bureau, 63 commission, authority, district, or agency thereof, or public 64 school, Florida College System institution, state university, or 65 associated board. 66 (c)(d)“Website” means a site on the Internet which is 67 easily accessible to the public at no cost and does not require 68 the user to provide information. 69(7)By November 1, 2013, and annually thereafter, the70committee shall recommend to the President of the Senate and the71Speaker of the House of Representatives:72(a)Additional information to be added to a website, such73as whether to expand the scope of the information provided to74include state universities, Florida College System institutions,75school districts, charter schools, charter technical career76centers, local government units, and other governmental77entities.78(b)A schedule for adding information to the website by79type of information and governmental entity, including80timeframes and development entity.81(c)A format for collecting and displaying the additional82information.83(8)The manager of each website described in subsections84(4), (5), and (6) shall submit to the committee information85relating to the cost of creating and maintaining such website,86and the number of times the website has been accessed.87(9)The committee shall coordinate with the Financial88Management Information Board in developing recommendations for89including information on the website which is necessary to meet90the requirements of s. 215.91(8).91(13)The committee shall prepare an annual report detailing92progress in establishing the single website and providing93recommendations for enhancement of the content and format of the94website and related policies and procedures. The report shall be95submitted to the Governor, the President of the Senate, and the96Speaker of the House of Representatives by November 1.97 Section 3. This act shall take effect July 1, 2016.
