1                        A bill to be entitled 
2         An act relating to license plates; amending ss. 
3         320.08056 and 320.08058, F.S.; creating an I Believe 
4         license plate, a Florida Biodiversity Foundation 
5         license plate, a Preserving the Past license plate, a 
6         Trinity license plate, and a Children First license 
7         plate; establishing annual use fees for the plates; 
8         providing for the distribution of use fees received 
9         from the sale of the plates; creating s. 320.08069, 
10         F.S.; creating an In God We Trust motorcycle license 
11         plate; providing for the distribution of use fees 
12         received from the sale of the plate; providing an 
13         effective date.

15  Be It Enacted by the Legislature of the State of Florida: 
16 
17         Section 1. Paragraphs (rrr), (sss), (ttt), (uuu), and (vvv) 
18  are added to subsection (4) of section 320.08056, Florida 
19  Statutes, to read: 
20         320.08056 Specialty license plates.— 
21         (4) The following license plate annual use fees shall be 
22  collected for the appropriate specialty license plates: 
23         (rrr) I Believe license plate, $25. 
24         (sss) Florida Biodiversity Foundation license plate, $25. 
25         (ttt) Preserving the Past license plate, $25. 
26         (uuu) Trinity license plate, $25. 
27         (vvv) Children First license plate, $25. 
28         Section 2. Subsections (70), (71), (72), (73), and (74) are 
29  added to section 320.08058, Florida Statutes, to read: 
30         320.08058 Specialty license plates.— 
31         (70) I BELIEVE LICENSE PLATES.—Notwithstanding s. 
32  320.08053(1)(b) and (c), the department shall develop an I 
33  Believe license plate as provided in this section. 
34         (a) I Believe license plates must bear the colors and 
35  design approved by the department. The word “Florida” must 
36  appear at the top of the plate, and the words “I Believe” must 
37  appear at the bottom of the plate. 
38         (b)The department shall retain the first $60,000 of annual 
39  use fees received from the sale of the plates. Thereafter, the 
40  annual use fees shall be distributed to Faith in Teaching, Inc., 
41  which may retain all of such revenue until the startup costs to 
42  develop and establish the license plate program have been 
43  recovered. Thereafter, Faith in Teaching, Inc., may use the 
44  proceeds as follows: 
45         1.A maximum of 15 percent may be used for administrative 
46  costs of the organization. 
47         2. A maximum of 10 percent may be used for promotion and 
48  the marketing costs of the license plate program. 
49         3.The remainder shall be used to fund activities, 
50  programs, and projects that promote faith-based education for 
51  youth within the state. 
52         (71) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.— 
53         (a) The department shall develop a Florida Biodiversity 
54  Foundation license plate as provided in this section. Florida 
55  Biodiversity Foundation license plates must bear the colors and 
56  design approved by the department. The word “Florida” must 
57  appear at the top of the plate, and the words “Save Wild 
58  Florida” must appear at the bottom of the plate. 
59         (b) The annual use fees shall be distributed to the Florida 
60  Biodiversity Foundation, Inc., which shall retain 50 percent of 
61  the proceeds until the startup costs to develop and establish 
62  the plates have been recovered. Thereafter, the proceeds shall 
63  be used as follows: 
64         1. A maximum of 25 percent of the proceeds may be used to 
65  fund the administrative, promotion, and marketing costs of the 
66  license plate program and the foundation. 
67         2. The remaining fees shall be used by the foundation to 
68  fund research, education, and scientific study of the diversity 
69  of animals and plants and to aid in the preservation, study, 
70  conservation, and recovery of imperiled organisms. 
71         (72) PRESERVING THE PAST LICENSE PLATES.— 
72         (a) The department shall develop a Preserving the Past 
73  license plate as provided in this section. The plate must bear 
74  the colors and design approved by the department. The word 
75  “Florida” must appear at the top of the plate, and the words 
76  “Preserving the Past” must appear at the bottom of the plate. 
77         (b) The annual use fees shall be distributed to the Toomey 
78  Foundation for the Natural Sciences, Inc., which shall retain 50 
79  percent of the proceeds until the startup costs to develop and 
80  establish the plates have been recovered. Thereafter, the 
81  proceeds shall be used as follows: 
82         1. A maximum of 25 percent of the proceeds may be used to 
83  fund the administrative, promotion, and marketing costs of the 
84  license plate program and the foundation. 
85         2. The remaining fees shall be used by the foundation to 
86  acquire, manage, and preserve properties that are of scientific 
87  importance to paleontologists, archeologists, or geologists for 
88  the purposes of research and education, and to promote and 
89  protect the unique natural sciences of this state. 
90         (73) TRINITY LICENSE PLATES.— 
91         (a) The department shall develop a Trinity license plate as 
92  provided in this section. The plate must bear the colors and 
93  design approved by the department. The word “Florida” must 
94  appear at the top of the plate and the words “Sunshine State” 
95  must appear at the bottom of the plate. 
96         (b) The annual use fees shall be distributed to the Toomey 
97  Foundation for the Natural Sciences, Inc., which shall retain 50 
98  percent of the proceeds until the startup costs to develop and 
99  establish the plates have been recovered. Thereafter, the 
100  proceeds shall be used as follows: 
101         1. A maximum of 25 percent of the proceeds may be used to 
102  fund the administrative, promotion, and marketing costs of the 
103  license plate program and the foundation. 
104         2. The remaining fees shall be used by the foundation to 
105  support educational, research, and scientific activities in this 
106  state, including the distribution of funds to qualified entities 
107  in furtherance of the stated purposes of the foundation. 
108         (74) CHILDREN FIRST LICENSE PLATES.— 
109         (a)The department shall develop a Children First license 
110  plate as provided in this section. The plate must bear the 
111  colors and design approved by the department. The word “Florida” 
112  must appear at the top of the plate and the words “Children 
113  First” must appear at the bottom of the plate. 
114         (b)The annual use fees shall be distributed to Children 
115  First Florida, Inc., which shall retain all proceeds until the 
116  startup costs to develop and establish the plates have been 
117  recovered. Thereafter, the proceeds shall be used as follows: 
118         1.A maximum of 15 percent of the proceeds may be used to 
119  administer the license plate program and for direct 
120  administrative costs associated with the operations of Children 
121  First Florida, Inc. 
122         2.A maximum of 10 percent of the proceeds may be used to 
123  promote and market the license plates. 
124         3.The remaining fees shall be used by Children First 
125  Florida, Inc., to fund public schools in this state, including 
126  teacher salaries. 
127         Section 3. Section 320.08069, Florida Statutes, is created 
128  to read: 
129         320.08069Motorcycle In God We Trust specialty license 
130  plates.— 
131         (1)Notwithstanding the provisions of s. 320.08053, the 
132  department shall develop a reduced dimensions In God We Trust 
133  specialty license plate for display on motorcycles. 
134         (2)The department shall issue the plate to the owner or 
135  lessee of any motorcycle upon request and payment of the 
136  appropriate license taxes and fees. 
137         (3)Each request must be made annually to the department, 
138  accompanied by the following taxes and fees: 
139         (a)The license tax required under s. 320.08. 
140         (b)A license plate fee as required by s. 320.06(1)(b). 
141         (c)A processing fee of $2. 
142         (d)A license plate annual use fee of $30. 
143         (4)The annual use fees shall be distributed to the In God 
144  We Trust Foundation, Inc., which shall expend the funds as 
145  provided in s. 320.08058(67), except that the foundation may 
146  retain a maximum of 25 percent of the proceeds from the sale of 
147  the license plate for the costs of administration, promotion, 
148  and marketing of the plates. 
149         (5)If an owner or lessee to whom the department has issued 
150  a license plate acquires a replacement vehicle within the 
151  owner’s registration period, the department must authorize a 
152  transfer of the specialty license plate to the replacement 
153  vehicle in accordance with s. 320.0609. The annual use fee or 
154  processing fee may not be refunded. 
155         (6)The license plate shall be 4 inches wide by 7 inches 
156  long and incorporate a red, white, and blue color scheme 
157  approved for the In God We Trust plates authorized in s. 
158  320.08058(67) and may bear the imprint of numerals from 1 to 
159  999, inclusive, capital letters “A” through “Z,” or a 
160  combination thereof. The department shall determine the maximum 
161  number of characters, including numerals and letters. The word 
162  “Florida” must appear at the top of the plate. 
163         Section 4. This act shall take effect July 1, 2010.
