Florida Senate - 2019 CS for CS for SB 1500 By the Committees on Appropriations; and Environment and Natural Resources; and Senator Simmons 576-04188-19 20191500c2 1 A bill to be entitled 2 An act relating to right of entry; amending s. 270.11, 3 F.S.; revising when a local government, a water 4 management district, or an agency of the state is 5 required to sell or release reserved interest in a 6 parcel of land; releasing right of entry reserved by a 7 local government, water management district, or other 8 agency of the state for specified parcels of property; 9 providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (b) of subsection (2) and subsection 14 (3) of section 270.11, Florida Statutes, are amended to read: 15 270.11 Contracts for sale of public lands to reserve 16 certain mineral rights; prohibition on exercise of right of 17 entry in certain cases.— 18 (2) 19 (b) A local government, a water management district, or an 20 agency of the state may, at its discretion, sell or release 21 reserved interest in any parcel of land, except that such sale 22 or release shall be made upon petition of the owner of the 23 parcel of land with a statement of reasons justifying such sale 24 or release. 25 (3) The right of entryin respectto any interest in 26 phosphate, minerals, and metals or any interest in petroleum 27 heretofore or hereafter reserved in favor of the Board of 28 Trustees of the Internal Improvement Trust Fund,orthe State 29 Board of Education, a local government, a water management 30 district, or other agency of the state isherebyreleased foras31toany parcel of property that is, or ever has been, a 32 contiguous tract of less than 20 acres in the aggregate under 33 the same ownership. 34(3) A local government, water management district, or35agency of the state may, at its discretion, sell or release36reserved interest in any parcel of land, except that such sale37or release shall be made upon petition of the purchaser for such38interest and with a statement of reasons justifying such sale or39release.40 Section 2. This act shall take effect July 1, 2019.
