    1                        A bill to be entitled                      
    2         An act relating to rehabilitation projects for
    3         petroleum contamination sites; amending s. 376.30711,
    4         F.S.; deleting provisions requiring the Department of
    5         Environmental Protection to preapprove costs or use
    6         performance-based contracts for site rehabilitation
    7         projects; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (a) of subsection (2) of section
   12  376.30711, Florida Statutes, is amended to read:
   13         376.30711 Preapproved Site rehabilitation, effective March
   14  29, 1995.—
   15         (2)(a) Competitive bidding pursuant to this section is
   16  shall not be subject to the requirements of s. 287.055. The
   17  department may is authorized to use competitive bid procedures
   18  or negotiated contracts for preapproving all costs and
   19  rehabilitation procedures for site-specific rehabilitation
   20  projects through performance-based contracts. Site
   21  rehabilitation shall be conducted according to the priority
   22  ranking order established pursuant to s. 376.3071(5).
   23         Section 2. This act shall take effect July 1, 2013.
