1                        A bill to be entitled 
2         An act relating to the Parole Commission; amending s. 
3         20.32, F.S.; renaming the Parole Commission as the 
4         “Florida Offender Review and Transition Commission”; 
5         requesting assistance during the interim of the 
6         Division of Statutory Revision in preparing conforming 
7         legislation for the 2011 Regular Session; providing an 
8         effective date.

10  Be It Enacted by the Legislature of the State of Florida: 
11 
12         Section 1. Section 20.32, Florida Statutes, is amended to 
13  read: 
14         20.32 Parole Commission.— 
15         (1) The Parole and Probation Commission, authorized by s. 
16  8(c), Art. IV, State Constitution of 1968, is continued and 
17  renamed the Florida Offender Review and Transition Parole 
18  Commission. The commission retains its powers, duties, and 
19  functions with respect to the granting and revoking of parole 
20  and shall exercise powers, duties, and functions relating to 
21  investigations of applications for clemency as directed by the 
22  Governor and the Cabinet. 
23         (2) All powers, duties, and functions relating to the 
24  appointment of the Parole Commission as provided in s. 947.02 or 
25  s. 947.021 shall be exercised and performed by the Governor and 
26  the Cabinet. Except as provided in s. 947.021, each appointment 
27  shall be made from among the first three eligible persons on the 
28  list of the persons eligible for said position. 
29         (3) The commission may require any employee of the 
30  commission to give a bond for the faithful performance of his or 
31  her duties. The commission may determine the amount of the bond 
32  and must approve the bond. In determining the amount of the 
33  bond, the commission may consider the amount of money or 
34  property likely to be in custody of the officer or employee at 
35  any one time. The premiums for the bonds must be paid out of the 
36  funds of the commission. 
37         Section 2. The Legislature recognizes that there is a need 
38  to amend the Florida Statutes to reflect the change in the name 
39  of the Parole Commission and that there may be a need to resolve 
40  apparent conflicts between other legislation that has been or 
41  may be enacted during 2010. Therefore, in the interim between 
42  July 1, 2010, and the 2011 Regular Session of the Legislature, 
43  the Division of Statutory Revision shall provide the relevant 
44  substantive committees of the Senate and the House of 
45  Representatives with assistance, upon request, to enable such 
46  committees to prepare draft legislation to conform the Florida 
47  Statutes and any legislation enacted during 2010 to the 
48  provisions of this act. 
49         Section 3. This act shall take effect July 1, 2010.
