SB 1248 First Engrossed 20181248e1 1 A bill to be entitled 2 An act relating to specialty license plates; amending 3 ss. 320.08056 and 320.08058, F.S.; directing the 4 Department of Highway Safety and Motor Vehicles to 5 develop a Coastal Conservation Association license 6 plate; establishing an annual use fee for the plate; 7 providing for distribution and use of fees collected 8 from the sale of the plates; revising the distribution 9 and use of the proceeds for the Live the Dream license 10 plate; requiring, by a specified date, the annual use 11 fees withheld by the department from the sale of the 12 Live the Dream specialty license plate to be used 13 first to satisfy all outstanding royalty payments due 14 to The Martin Luther King, Jr. Center for Nonviolent 15 Social Change, Inc., for the use of the image of Dr. 16 Martin Luther King, Jr.; requiring all remaining funds 17 to be distributed to the subrecipients on a pro rata 18 basis according to the percentages specified in s. 19 320.08058(48), F.S.; providing an effective date. 20 21 Be It Enacted by the Legislature of the State of Florida: 22 23 Section 1. Paragraph (ffff) is added to subsection (4) of 24 section 320.08056, Florida Statutes, to read: 25 320.08056 Specialty license plates.— 26 (4) The following license plate annual use fees shall be 27 collected for the appropriate specialty license plates: 28 (ffff) Coastal Conservation Association license plate, $25. 29 Section 2. Subsection (48) of section 320.08058, Florida 30 Statutes, is amended, and subsection (84) is added to that 31 section, to read: 32 320.08058 Specialty license plates.— 33 (48) LIVE THE DREAM LICENSE PLATES.— 34 (a) The department shall develop a Live the Dream license 35 plate as provided in this section. Live the Dream license plates 36 must bear the colors and design approved by the department. The 37 word “Florida” must appear at the top of the plate, and the 38 words “Live the Dream” must appear at the bottom of the plate. 39 (b) The proceeds of the annual use fee shall be distributed 40 to the Dream Foundation, Inc., toThe Dream Foundation, Inc.,41shall retain the first $60,000 in proceeds from the annual use42fees as reimbursement for administrative costs, startup costs,43and costs incurred in the approval process. Thereafter, up to 2544percent shall be used for continuing promotion and marketing of45the license plate and concept. The remaining funds shallbe used 46 in the following manner: 47 1. Up to 5 percent may be used to administer, promote, and 48 market the license plate. 49 2.1.At least 30Twenty-fivepercent shall be distributed 50 equally among the sickle cell organizations that are Florida 51 members of the Sickle Cell Disease Association of America, Inc., 52 for programs that provide research, care, and treatment for 53 sickle cell disease. 54 3.2.At least 30Twenty-fivepercent shall be distributed 55 to the Florida chapter of the March of Dimes for programs and 56 services that improve the health of babies through the 57 prevention of birth defects and infant mortality. 58 4.3.At least 15Tenpercent shall be distributed to the 59 Florida Association of Healthy Start Coalitions to decrease 60 racial disparity in infant mortality and to increase healthy 61 birth outcomes. Funding will be used by local Healthy Start 62 Coalitions to provide services and increase screening rates for 63 high-risk pregnant women, children under 4 years of age, and 64 women of childbearing age. 65 5.4.At least 15Tenpercent shall be distributed to 66 Chapmanthe CommunityPartnershipfor Homeless, Inc., for 67 programs that provide relief from poverty, hunger, and 68 homelessness. 69 6. Up to 5 percent may be distributed by the department on 70 behalf of The Dream Foundation, Inc., to The Martin Luther King, 71 Jr. Center for Nonviolent Social Change, Inc., as a royalty for 72 the use of the image of Dr. Martin Luther King, Jr. 735. Five percent of the proceeds shall be used by the74foundation for administrative costs directly associated with75operations as they relate to the management and distribution of76the proceeds.77 (84) COASTAL CONSERVATION ASSOCIATION LICENSE PLATES.— 78 (a) The department shall develop a Coastal Conservation 79 Association license plate as provided in this section and s. 80 320.08053. The plate must bear the colors and design approved by 81 the department. The word “Florida” must appear at the top of the 82 plate, and the words “Conserve Florida’s Fisheries” must appear 83 at the bottom of the plate. 84 (b) The annual use fees from the sale of the plate shall be 85 distributed to Coastal Conservation Association Florida, a 86 nonprofit corporation under s. 501(c)(3) of the Internal Revenue 87 Code, to be used as follows: 88 1. Up to 10 percent of the proceeds may be used for 89 administrative costs. 90 2. Up to 10 percent of the proceeds may be used to promote 91 and market the plate. 92 3. The remainder of the proceeds shall be used to support 93 the mission and efforts of Coastal Conservation Association 94 Florida for habitat enhancement and restoration, saltwater 95 fisheries conservation, and education; to advise the public on 96 the conservation of marine resources; and to promote and enhance 97 the present and future availability of those coastal resources 98 for the benefit and enjoyment of the general public. 99 Section 3. By November 1, 2018, the annual use fees 100 withheld by the Department of Highway Safety and Motor Vehicles 101 from the sale of the Live the Dream specialty license plate 102 shall be used first to satisfy all outstanding royalty payments 103 due to The Martin Luther King, Jr. Center for Nonviolent Social 104 Change, Inc., for the use of the image of Dr. Martin Luther 105 King, Jr. All remaining funds shall be distributed to the 106 subrecipients on a pro rata basis according to the percentages 107 specified in s. 320.08058(48), Florida Statutes. 108 Section 4. This act shall take effect October 1, 2018.
