Florida Senate - 2015 SB 1238 By Senator Bullard 39-01034-15 20151238__ 1 A bill to be entitled 2 An act relating to specialty license plates; amending 3 ss. 320.08056 and 320.08058, F.S.; requiring the 4 Department of Highway Safety and Motor Vehicles to 5 create a Florida Bay Forever license plate; 6 establishing an annual use fee for the plate; 7 providing for the distribution of use fees received 8 from the sale of such plates; providing an effective 9 date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (iiii) is added to subsection (4) of 14 section 320.08056, Florida Statutes, to read: 15 320.08056 Specialty license plates.— 16 (4) The following license plate annual use fees shall be 17 collected for the appropriate specialty license plates: 18 (iiii) Florida Bay Forever license plate, $25. 19 Section 2. Subsection (87) is added to section 320.08058, 20 Florida Statutes, to read: 21 320.08058 Specialty license plates.— 22 (87) FLORIDA BAY FOREVER LICENSE PLATES.— 23 (a) Notwithstanding s. 45 of chapter 2008-176, Laws of 24 Florida, as amended by s. 45 of chapter 2014-216, Laws of 25 Florida, and s. 320.08053(1), the department shall develop a 26 Florida Bay Forever license plate as provided in s. 320.08053(2) 27 and (3) and this section. The word “Florida” must appear at the 28 top of the plate and the words “Florida Bay Forever” must appear 29 at the bottom of the plate. 30 (b) The department shall retain all annual use fees from 31 the sale of such plates until all startup costs for developing 32 and issuing the plates have been recovered. Thereafter, the 33 annual use fees shall be distributed to the Florida National 34 Park Association, Inc., which may use up to 10 percent of such 35 fees for administrative costs and marketing of the plate. The 36 balance of the fees shall be used to supplement the Everglades 37 National Park service’s budgets and to support educational, 38 interpretive, historical, and scientific research relating to 39 the Everglades National Park. 40 Section 3. This act shall take effect July 1, 2015.
