Florida Senate - 2023 SB 1222 By Senator Powell 24-01058-23 20231222__ 1 A bill to be entitled 2 An act relating to corporate practice of medicine; 3 amending s. 458.331, F.S.; providing additional acts 4 that constitute grounds for denial of a license to 5 practice medicine or for disciplinary action, to which 6 penalties apply; providing an effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Paragraphs (xx) and (yy) are added to subsection 11 (1) of section 458.331, Florida Statutes, to read: 12 458.331 Grounds for disciplinary action; action by the 13 board and department.— 14 (1) The following acts constitute grounds for denial of a 15 license or disciplinary action, as specified in s. 456.072(2): 16 (xx) Being employed by any corporation, organization, 17 group, or person other than a physician or a professional 18 corporation, limited liability company, or nonprofit 19 organization composed of licensed physicians. 20 (yy) Allowing any person other than a physician or a 21 professional corporation, limited liability company, or 22 nonprofit organization composed of licensed physicians to 23 direct, control, or interfere with a physician’s clinical 24 judgement, patient’s medical record, or physician’s billing and 25 personnel practices, including hours of practice. 26 Section 2. This act shall take effect July 1, 2023.
