    1                        A bill to be entitled                      
    2         An act relating to referendums to increase millage;
    3         amending s. 200.65, F.S.; prohibiting any increase in
    4         a taxing authority’s millage rate from going into
    5         effect until it has been approved by a specified vote;
    6         providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Paragraph (c) is added to subsection (5) of
   11  section 200.065, Florida Statutes, to read:
   12         200.065 Method of fixing millage.—
   13         (5) In each fiscal year:
   14         (c)Any increase in the millage rate may not go into effect
   15  until it is approved by a two-thirds vote of the qualified
   16  electors in the county or district voting in a general election,
   17  as defined in s. 97.021, called for such purpose.

   19  Any unit of government operating under a home rule charter
   20  adopted pursuant to ss. 10, 11, and 24, Art. VIII of the State
   21  Constitution of 1885, as preserved by s. 6(e), Art. VIII of the
   22  State Constitution, which is granted the authority in the State
   23  Constitution to exercise all the powers conferred now or
   24  hereafter by general law upon municipalities and which exercises
   25  such powers in the unincorporated area shall be recognized as a
   26  municipality under this subsection. For a downtown development
   27  authority established before the effective date of the State
   28  Constitution which has a millage that must be approved by a
   29  municipality, the governing body of that municipality shall be
   30  considered the governing body of the downtown development
   31  authority for purposes of this subsection.
   32         Section 2. This act shall take effect July 1, 2024.
