    1                        A bill to be entitled                      
    2         An act relating to the statute of limitations for
    3         sexual offenses; amending s. 95.11, F.S.; extending
    4         the statute of limitations period for civil actions
    5         for certain offenses; providing applicability;
    6         authorizing certain persons to bring causes of action
    7         that were previously barred for specified reasons;
    8         providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (9) of section 95.11, Florida
   13  Statutes, is amended to read:
   14         95.11 Limitations other than for the recovery of real
   15  property.—Actions other than for recovery of real property shall
   16  be commenced as follows:
   17         (9) SEXUAL BATTERY OFFENSES ON VICTIMS UNDER AGE 16.—
   18         (a) An action related to an act constituting a violation of
   19  s. 794.011 involving a victim who was younger than under the age
   20  of 16 at the time of the act may be commenced at any time. This
   21  paragraph subsection applies to any such action other than one
   22  which would have been time barred on or before July 1, 2010.
   23         (b)1.Except as provided in paragraph (a), an action
   24  related to an act constituting a violation of s. 794.011, s.
   25  800.02, s. 800.03, s. 800.09, or s. 800.101 may be commenced at
   26  any time. This paragraph applies to any such action other than
   27  one which would have been time barred on or before July 1, 2020.
   28         2.If a person commences such an action between December
   29  31, 2020, and January 1, 2022, he or she may bring a cause of
   30  action under subparagraph 1. for a claim that was previously
   31  barred by a statute of limitation or by the failure of that
   32  person to file a notice of claim or notice of intention to file
   33  a claim.
   34         Section 2. This act shall take effect July 1, 2020.
