Florida Senate - 2022 SB 1136 By Senator Jones 35-01291-22 20221136__ 1 A bill to be entitled 2 An act relating to at-home drug deactivation and 3 disposal systems; creating s. 381.888, F.S.; defining 4 terms; requiring the Department of Health, in 5 coordination with the Board of Pharmacy, to establish 6 and administer the At-home Drug Deactivation and 7 Disposal System Program for a specified purpose; 8 providing requirements for the at-home drug 9 deactivation and disposal systems; requiring the 10 department, in coordination with the board, to develop 11 relevant educational materials and a plan for 12 distribution of the at-home drug deactivation and 13 disposal systems and educational materials; requiring 14 the department, in consultation with the board, to 15 adopt rules; providing an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. Section 381.888, Florida Statutes, is created to 20 read: 21 381.888 At-home Drug Deactivation and Disposal System 22 Program.— 23 (1) DEFINITIONS.—As used in this section, the term: 24 (a) “Board” means the Board of Pharmacy. 25 (b) “Department” means the Department of Health. 26 (c) “Nonretrievable” has the same meaning as in 21 C.F.R. 27 s. 1300.05(b), as that definition exists on the effective date 28 of this act. 29 (d) “Pharmacy” has the same meaning as in s. 465.003(11). 30 (e) “Program” means the At-home Drug Deactivation and 31 Disposal System Program. 32 (2) PROGRAM ESTABLISHED.— 33 (a) The department, in coordination with the board, shall 34 establish and administer the At-home Drug Deactivation and 35 Disposal System Program for the purpose of identifying and 36 distributing suitable at-home drug deactivation and disposal 37 systems that pharmacies must co-dispense with each opioid 38 prescription. An at-home drug deactivation and disposal system 39 must be capable of all of the following: 40 1. Safely disposing of an opioid drug prescribed pursuant 41 to s. 456.44(5)(a) for the treatment of acute pain. 42 2. Permanently rendering the active pharmaceutical 43 ingredient nonretrievable, nonusable, and environmentally safe 44 for disposal. 45 (b) The department, in coordination with the board, shall 46 develop relevant educational materials and a plan for 47 distribution of the at-home drug deactivation and disposal 48 systems and educational materials to pharmacies in this state. 49 (3) RULEMAKING AUTHORITY.—The department, in consultation 50 with the board, shall adopt rules to administer the program. 51 Section 2. This act shall take effect July 1, 2022.
