Florida Senate - 2016 SB 906 By Senator Latvala 20-00621A-16 2016906__ 1 A bill to be entitled 2 An act relating to the sale of liquid fuels; amending 3 s. 526.303, F.S.; revising the term “refiner”; 4 amending s. 526.304, F.S.; prohibiting a producer, 5 refiner, or subsidiary from operating a retail outlet 6 selling its petroleum products under its own brand or 7 secondary brand; providing a penalty; providing an 8 effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Subsection (10) of section 526.303, Florida 13 Statutes, is amended to read: 14 526.303 Definitions.—As used in this act: 15 (10) “Refiner” means any person who is engaged in refining 16 crude oil to produce motor fuel, and includes any affiliate of 17 such personstores or exchanges motor fuel at a terminal18facility in this state and who sells or transfers motor fuel19through the loading rack at such terminal facility, and includes20an affiliate of such refiner with respect to such affiliate’s21sale of motor fuel. 22 Section 2. Subsection (4) is added to section 526.304, 23 Florida Statutes, to read: 24 526.304 Predatory practices unlawful; exceptions.— 25 (4) After October 1, 2016, a producer, a refiner, or a 26 subsidiary of any producer or refiner may not operate with 27 company personnel any retail outlet selling its petroleum 28 products under its own brand or secondary brand. A person 29 violating this subsection is subject to an action for injunctive 30 relief under s. 526.311 or s. 526.312. 31 Section 3. This act shall take effect July 1, 2016.
