    1                        A bill to be entitled                      
    2         An act relating to public records; amending s.
    3         379.249, F.S.; exempting from public records
    4         requirements the personal information contained in
    5         site files or records which identifies the location of
    6         artificial reefs funded with private contributions;
    7         providing for future legislative review and repeal
    8         under the Open Government Sunset Review Act; providing
    9         a statement of public necessity; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (5) of section 379.249, Florida
   15  Statutes, is amended to read:
   16         379.249 Artificial reef program; grants and financial and
   17  technical assistance to local governments.—
   18         (5)(a) The commission’s artificial reef program shall track
   19  all artificial-reef-development activities statewide, and
   20  maintain a computer database of these activities for the public
   21  interest and to facilitate long-range planning and coordination
   22  within the commission and among local governments.
   23         (b) Information that identifies the location of an
   24  artificial reef funded with private contributions which is
   25  contained in site files or records maintained by an agency as
   26  defined in s. 119.011 is exempt from s. 119.07(1) and from s.
   27  24(a), Art. I of the State Constitution. This paragraph is
   28  subject to the Open Government Sunset Review Act in accordance
   29  with s. 119.15, and shall stand repealed on October 2, 2020,
   30  unless reviewed and saved from repeal through reenactment by the
   31  Legislature.
   32         Section 2. The Legislature finds that it is a public
   33  necessity that information that identifies the location of an
   34  artificial reef funded with private contributions and which is
   35  held by an agency as defined in s. 119.011 be made exempt from
   36  s. 119.07(1), Florida Statutes, and s. 24(a), Article I of the
   37  State Constitution. The Legislature finds that disclosing the
   38  locations of artificial reefs funded with private contributions
   39  would discourage the artificial reef building partnership
   40  programs with coastal local governments. Thus, the Legislature
   41  finds that strengthening the artificial reef building
   42  partnership programs outweighs any public benefit that may be
   43  derived from the disclosure of such information.
   44         Section 3. This act shall take effect upon becoming a law.
