Florida Senate - 2016 CS for SB 818 By the Committee on Health Policy; and Senators Latvala and Sobel 588-02621-16 2016818c1 1 A bill to be entitled 2 An act relating to instruction on human trafficking; 3 amending s. 456.031, F.S.; providing that certain 4 licensing boards must require specified licensees to 5 complete a specified continuing education course that 6 includes a section on human trafficking as a condition 7 of relicensure or recertification; providing 8 requirements and procedures related to the course; 9 providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 456.031, Florida Statutes, is amended to 14 read: 15 456.031 Requirement for instruction on domestic violence 16 and human trafficking.— 17 (1)(a) The appropriate board shall require each person 18 licensed or certified under chapter 458, chapter 459, part I of 19 chapter 464, chapter 466, chapter 467, chapter 490, or chapter 20 491 to complete a 2-hour continuing education course, approved 21 by the board, on domestic violence, as defined in s. 741.28, and 22 on human trafficking, as defined in s. 787.06(2), as part of 23 every third biennial relicensure or recertification. 24 1. The domestic violence section of the course mustshall25 consist of data and information on the number of patients in 26 that professional’s practice who are likely to be victims of 27 domestic violence and the number who are likely to be 28 perpetrators of domestic violence, screening procedures for 29 determining whether a patient has any history of being either a 30 victim or a perpetrator of domestic violence, and instruction on 31 how to provide such patients with information on, or how to 32 refer such patients to, resources in the local community, such 33 as domestic violence centers and other advocacy groups, that 34 provide legal aid, shelter, victim counseling, batterer 35 counseling, or child protection services. 36 2. The human trafficking section of the course must consist 37 of data and information on the types of human trafficking, such 38 as labor and sex, and the extent of human trafficking; factors 39 that place a person at greater risk for being a victim of human 40 trafficking; management of medical records of patients who are 41 human trafficking victims; patient safety and security; public 42 and private social services available for rescue, food, 43 clothing, and shelter referrals; hotlines for reporting human 44 trafficking maintained by the National Human Trafficking 45 Resource Center and the United States Department of Homeland 46 Security; validated assessment tools for identifying human 47 trafficking victims and general indicators that a person may be 48 a victim of human trafficking; procedures for sharing 49 information related to human trafficking with a patient; and 50 referral options for legal and social services. 51 (b) Eachsuchlicensee or certificateholder shall submit 52 confirmation of having completed the continuing educationsuch53 course, on a form provided by the board, when submitting fees 54 for every third biennial relicensure or recertificationrenewal. 55 (c) The board may approve additional equivalent courses 56 that may be used to satisfy the requirements of paragraph (a). 57 Each licensing board that requires a licensee to complete a 58 continuinganeducational course pursuant to this subsection may 59 include the hour required for completion of the course in the 60 total hours of continuing education required by law for thesuch61 profession, unless the continuing education requirements for the 62suchprofession consist of fewer than 30 hours of continuing 63 education biennially. 64 (d) Any person holding two or more licenses subject tothe65provisions ofthis subsection shall be permitted to show proof 66 of completion ofhaving takenone board-approved course on 67 domestic violence and human trafficking, for purposes of 68 relicensure or recertification for additional licenses. 69 (e) Failure to comply with the requirements of this 70 subsection shall constitute grounds for disciplinary action 71 under each respective practice act and under s. 456.072(1)(k). 72 In addition to discipline by the board, the licensee shall be 73 required to complete the board-approvedsuchcourse under this 74 subsection. 75 (2) Each board may adopt rules to carry out the provisions 76 of this section. 77 Section 2. This act shall take effect July 1, 2016.
