    1                        A bill to be entitled                      
    2         An act relating to fees; amending s. 509.243, F.S.;
    3         requiring the Division of Hotels and Restaurants of
    4         the Department of Business and Professional Regulation
    5         to adopt by rule a schedule of fees for hosting
    6         platforms that wish to advertise or list transient
    7         public lodging establishments; requiring the division
    8         to deposit such fees into the Hotel and Restaurant
    9         Trust Fund; specifying the maximum aggregate annual
   10         registration fee per hosting platform; providing a
   11         contingent effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Subsection (8) is added to section 509.243,
   16  Florida Statutes, as created by SB ____, 2019 Regular Session,
   17  or similar legislation, to read:
   18         509.243 Hosting platforms for transient public lodging
   19  establishments.—
   20         (8)The division shall adopt by rule a schedule of fees
   21  that each hosting platform must pay as a prerequisite to the
   22  issuance or renewal of a registration. The division shall
   23  deposit the fees into the Hotel and Restaurant Trust Fund. The
   24  fees must be based upon the number of transient public lodging
   25  establishments served by the hosting platform. The aggregate
   26  annual registration fee per hosting platform may not exceed
   27  $1,000.
   28         Section 2. This act shall take effect on the same date that
   29  SB ____ or similar legislation takes effect, if such legislation
   30  is adopted in the same legislative session or an extension
   31  thereof and becomes a law.
